Bring Your Own Device Program Terms and Conditions
If you are a BusinessLinc customer with Southern Communications Services, Inc. d/b/a Southern Linc ("Southern Linc"), you may use a phone and/or data equipment and related accessories (each, a "Device") not purchased from Southern Linc or a Southern Linc Authorized Dealer in connection with your BusinessLinc service ("BusinessLinc Service") on the voice and data network of our underlying wireless service provider ("System"), subject to the terms, conditions, and disclaimers of the Bring Your Own Device Program (the "BYOD Program"). The following terms, conditions, and disclaimers apply to the BYOD Program:
- (a) Compatible Devices. The Device you use must be eligible and technologically compatible for use on the System, which may be determined by us in our sole discretion. Notwithstanding a Device’s eligibility and compatibility, a Device may not work with your BusinessLinc Service even if it is eligible and compatible with our System, or some features of the Device may not function properly when activated with BusinessLinc and BusinessLinc may not support all features. Payment for service does not guaranty that your Device will work with your BusinessLinc Service. Your Device may be rejected for any reason. The typical reasons for which your Device will be rejected include: (i) your Device is active with another carrier at the time of BusinessLinc Service activation and you have not properly completed the porting process, or (ii) your Device has been blacklisted as stolen or otherwise ineligible for activation.
- (b) Porting. When you attempt to port a number to a Device you intend to use under the BYOD Program, there may be a failure or time delay in the process resulting in your inability to use your device with your BusinessLinc Service or any other wireless service. Any such failure is likely the result of a problem with your Device or its compatibility with your BusinessLinc Service. You agree that any port attempt is done at your own risk and that Southern Linc has no responsibility for any delays or failures in the porting or device import process. Southern Linc is not responsible for restoring your number to your former or any other service even if the port process fails due to Device incompatibility or ineligibility. In addition, you understand that Southern Linc has no obligation to provide any technical support for the porting or device import process.
- (c) Assumption of Risk. Southern Linc offers no guarantees, representations, warranties, or assurances of any kind with respect to any Device not purchased from Southern Linc or a Southern Linc Authorized Dealer or BusinessLinc Service purchased for use in connection with such Device. The Device may not work with your BusinessLinc Service in some particular or any respect. Southern Linc does not offer support of any kind for any such Device and has no obligation to you in respect of any such Device, whether hardware or software related, and makes no representations or warranties as to your Device’s compatibility with any network, system or software, including, without limitation, the System. Use of your Device with your BusinessLinc Service may void any manufacturer’s warranty and Southern Linc is not responsible for any such voidance.
YOU AGREE THAT SOUTHERN LINC IS NOT RESPONSIBLE FOR, AND YOU ASSUME ALL RISK FOR, YOUR USE OF ANY SUCH DEVICE WITH YOUR BUSINESSLINC SERVICE AND AGREE THAT YOU ARE RESPONSIBLE IN FULL FOR YOUR SERVICE TERMS AND ALL APPLICABLE CHARGES REGARDLESS AS TO WHETHER OR NOT YOUR DEVICE PROPERLY FUNCTIONS WITH YOUR BUSINESSLINC SERVICE OR OTHERWISE. Other than as specifically provided for under these BYOD Program Terms, you agree that because Southern Linc is not responsible for, and that you assume all risk for, any Device you use under the BYOD Program, your BusinessLinc Service payment is non-refundable due to any failure or other issue with importing your Device, even in the event your Device is rejected or otherwise does not work with your BusinessLinc Service after payment.
